1. Acceptance of Terms

By accessing or using the PropertyManagement.com website, services, or platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and PropertyManagement.com, LLC ("Company," "we," "us," or "our"). If you do not agree to these Terms, you may not use our Services.

These Terms apply to all users, including property management companies (whether Verified or Unverified), property owners, and site visitors.

2. Eligibility and U.S.-Only Service Scope

Our Services are intended for use only within the United States. By using the Services, you represent and warrant that you reside in the United States and are at least 18 years of age. We do not knowingly market to or collect information from users outside the United States.

3. Platform Use and Content

You may access and use the Services solely for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the platform for unlawful, fraudulent, or deceptive activities;
  • Interfere with or disrupt the Services;
  • Attempt to access data not intended for you;
  • Circumvent any security or authentication measures;
  • Use any automated system, robot, spider, scraper, crawler, or similar mechanism to access, extract, or index any portion of the platform without our express written permission.

Scraping, harvesting, or extracting data from PropertyManagement.com without authorization is strictly prohibited and may result in legal action.

All rights, title, and interest in the Services and related content, including the structure, layout, algorithms, rankings, and badges (excluding user-submitted content), are the proprietary property of the Company.

4. Verified Property Manager Program

Verified Property Managers agree to additional terms set forth in a separate agreement. Participation includes:

  • Public listing as a Verified Property Manager;
  • Priority exposure in search results;
  • Access to qualified lead opportunities.

All Verified Managers must provide accurate business and operational data and agree to the licensing and usage terms outlined in the Client Agreement.

5. User-Submitted Content

Users may submit reviews, data, or other content to the platform. By submitting content, you grant the Company a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute the content in connection with the Services.

You represent that you have the rights to all submitted content and that it does not violate any third-party rights or laws.

If you believe that content on the platform infringes your copyright, you may submit a takedown notice pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent at [email protected].

6. Payment Terms

Verified Property Managers are subject to fees as described in the applicable Verified Property Manager Agreement. These may include:

  • Annual participation fees;
  • Per-lead fees for qualified inquiries;
  • Late payment penalties.

All fees are non-refundable unless otherwise stated in writing.

7. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which outlines how we collect, use, share, and protect your personal data. By using the Services, you acknowledge and accept the practices described in our Privacy Policy.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or reliability of any content or leads provided.

9. Limitation of Liability

To the fullest extent permitted by law, PropertyManagement.com shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Services. Our total liability shall not exceed the amount you have paid to us in the past 12 months.

10. Indemnification

You agree to indemnify, defend, and hold harmless PropertyManagement.com, its affiliates, officers, and employees from any claims, losses, or liabilities arising from your use of the Services, your content submissions, or your violation of these Terms.

11. Termination and Suspension

We reserve the right to suspend or terminate your access to the Services at any time, for any reason, including for violation of these Terms or failure to pay fees (where applicable). In cases of termination, we may provide notice and an opportunity to respond or appeal, at our discretion.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. Any disputes shall be resolved through binding arbitration in Marion County, Indiana under the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek equitable relief or file a claim in small claims court as permitted by law.

13. Enforcement and Remedies

In the event of a breach of these Terms, we reserve the right to pursue all available remedies including legal fees, injunctive relief, and damages. This includes violations related to scraping, data misuse, or infringement of our proprietary rights.

14. Supplemental Terms

Certain features or services, such as API access, analytics dashboards, or marketing packages, may be subject to additional terms and conditions. By using these features, you agree to the applicable supplemental terms.

15. Third-Party Services and Links

Our Services may include links to or integrations with third-party websites, tools, or services. We do not control and are not responsible for the content, practices, or privacy policies of third parties. Your use of third-party services is at your own risk.

16. Modifications to Terms

We may update these Terms from time to time. Material changes will be posted on this page and indicated by an updated Effective Date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

17. Notices

All notices, requests, and communications from the Company to users shall be delivered via email, website posting, or other reasonable electronic means. You agree that such communications satisfy any legal requirement that such communications be in writing.
